Welcome to Kimino Library. This Privacy Policy explains how Asuran Technologies ("we," "us," or "our") collects, uses, discloses, and protects your personal information when you use our website, applications, and services (collectively, the "Service").
By using our Service, you consent to the collection and use of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Service.
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Privacy Policy.

7.9 For Residents of Japan
Under Japan's Act on the Protection of Personal Information (APPI), you have the right to:
- Be informed of the purpose of use of your personal information
- Request disclosure of your retained personal data and records of its provision to third parties
- Request correction, addition, or deletion of your personal information

For photos of a minor, the minor's legal representative (parent or guardian) may exercise these rights on the minor's behalf. To exercise any of these rights, contact us at privacy@kiminolibrary.com. If you are not satisfied with our response, you may lodge a complaint with the Personal Information Protection Commission (PPC) of Japan (www.ppc.go.jp).
8. Data Security
We implement appropriate technical and organizational measures to protect your information, including:
- Encryption in transit: All data transmitted to and from our Service uses HTTPS/TLS encryption
- Secure authentication: User authentication is managed by Clerk, which implements industry-standard security practices
- Access controls: Access to user data is restricted to authorized personnel and systems

Data breach notification: Where a reportable data breach occurs, we will notify the relevant supervisory authority and affected individuals as required by applicable law. For users in Japan, this includes reporting qualifying breaches to the Personal Information Protection Commission (PPC) and notifying affected individuals in accordance with the APPI.
9. Children's Privacy
Our Service is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children under 18.
Regarding photos of minors: While users must be 18+ to use the Service, we permit parents and legal guardians to upload photos of their children for the purpose of creating personalized storybooks, as described in our Terms and Conditions. Parents and guardians are responsible for ensuring appropriate consent and use.
If we learn that we have collected personal information from a child under 18 without parental consent, we will take steps to delete that information promptly.
10. International Data Transfers
Asuran Technologies is based in Australia, but our core infrastructure and service providers are located in the United States. When you use the Service, your personal information — including account data, story text, uploaded reference photographs, and generated images — is transferred to, stored, and processed in the United States and other countries where our service providers operate (see the provider table in Section 4.1 for the location of each recipient).
10.1 Information for Users in Japan (Cross-Border Transfer under the APPI)
If you are located in Japan, the following disclosures are provided in accordance with Article 28 of Japan's Act on the Protection of Personal Information (APPI) before you consent to the transfer of your personal data outside Japan:
- Destination country: Your personal data is transferred to, and processed in, the United States (our providers Convex, Clerk, OpenRouter, Polar, and Meta are located there), the EU/EEA (Plunk stores hosted email data in Germany; PostHog may process data in the United States and/or the EU), and other countries where email delivery or AI processing may transit.
- Data-protection system of the destination country: The United States does not have a single comprehensive national data-protection law equivalent to the APPI, and it has not been designated by Japan's Personal Information Protection Commission (PPC) as a country providing an equivalent level of protection (currently only the EU/EEA and the UK hold that designation). Personal data in the United States is protected through a combination of sector-specific federal laws, state privacy laws (such as the CCPA/CPRA in California), and contractual safeguards. Under certain US laws, government authorities may be able to compel access to data.
- Protective measures taken by the recipients: We enter into data processing agreements with our service providers that contractually require them to handle personal data in a manner consistent with the standards required by the APPI, to implement appropriate security measures, and to limit use of the data to providing the Service. We do not permit these providers to use your content to train AI models. You may request further information about these measures by contacting us at privacy@kiminolibrary.com.
By providing the consent requested at sign-up and before creating a story with reference images, you consent to the transfer of your personal data — and, where you upload photos of others (including minors for whom you are the parent/guardian or have obtained their parent/guardian's consent), their personal data — to the United States as described above.
10.2 Other Users
By using our Service, you consent to the transfer of your information to countries that may have different data protection laws than your country of residence. We ensure appropriate safeguards are in place for such transfers.
11. Third-Party Links
Our Service may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access.
